What is the legal definition of a Judgment?



Judgment: A decision of a court of law respecting the issues before it. The outstanding characteristic of a legal judgment is its finality and fixity; thus, except for error justifying an appeal, the judgment may not be reconsidered. The judgment, which in most cases of consequence follows the verdict of a jury, is the determination of the judge that the defendant is guilty or innocent of the alleged offense. If the judgment is one of criminal guilt, the court proceeds to impose a sentence. In civil cases, when judgment is for the plaintiff, the court usually awards a sum as damages. The damages thereupon constitute a debt that takes priority over all other obligations of the defendant except taxes and previous judgments. The sheriff may also garnish monies owed to the defendant, e.g., his wages. Certain property of the debtor is exempt from seizure, including clothing, equipment needed to carry on his trade or profession, and the family homestead. In some jurisdictions a defendant who willfully refuses to pay a judgment may be punished for contempt of court. A judgment rendered by the courts of one state is entitled to recognition by the courts of all other states.

       

Types of judgments



Basically there are 2 types of restitution judgments.
  1. Civil -- A non-criminal case enveloping one party against the other.
  2. Criminal -- A criminal case enveloping one party against the other.
A judgment can be made against.
  1. An individual person or a party of persons.
  2. A business or corporation.
  3. A thing.
There are two more popular types of courts that you may obtain a judgment.
  1. Small claims court -- In small claims court the plaintiff may represent himself (also called pro se) and usually an attorney is not allowed. These types of claims are for smaller amounts of money, most likely in the hundreds of dollars range.
  2. Associate court -- This type of case an attorney must represent his client and the outcome is determined by a judge or a jury. The awards from these types of judgments may go into the hundreds of thousands or even millions of dollars range.

I have a judgment but I can not get it collected!


California Judgment Collection Now They owed me money...I sued them and won...but they refuse to pay me... What can I do? How do I get what I am rightfully owed? Why won't the courts collect my judgment?
Let's first come to facts. If the debtor was going to pay you, they would have already! The money is not going to walk into your lap. The debtor will not suddenly wake up one day and just decide he wants to now pay his debts and out of newfound honor deliver your money to your door.

This will not happen no matter how much you want it to!

 

Fact: While the courts attempt to see justice served by awarding a monetary judgment to the winner of a civil case, they do absolutely nothing to enforce payment. Enforcement is left up to the judgment winner! Most people, after a few years, give up hope of ever collecting the money they are owed!

Fact: Only about twenty percent of judgments are ever paid by the losing party. Eighty percent of all court awarded judgments go uncollected!

 

 

Why can't the winner of the judgment collect these legal debts?

  1. The debtor may have changed his residence to avoid payment and can't be located!
  2. He/She may have changed his/her name to avoid payment!
  3. He/She may have hidden his/her assets and claims to have no money to pay the judgment!
  4. He/She may have relocated to another state where the judgment is not valid!
